Cancellation Policy and Cancellation Form

1. Scope

This cancellation policy applies to consumers who, under the mandatory legal provisions of their country of habitual residence, are entitled to a right of cancellation, withdrawal, or termination of the contract.

Consumers are natural persons who enter into a contract primarily for purposes that cannot be attributed to their commercial or self-employed professional activities.

Bags and Seams Design sells exclusively digital content and digital services, specifically:

* digital sewing patterns and sewing instructions;
* other downloadable files;
* pre-recorded online courses;
* digital course materials and videos;
* personalized digital content, if applicable.

No physical goods will be shipped.

2. Notice for Customers in Switzerland

Under Swiss law, there is generally no statutory right of withdrawal or return for ordinary online purchases.

Bags and Seams Design does not grant any voluntary right of cancellation, return, or exchange for digital content and online courses.

Mandatory rights regarding digital content that is defective, erroneous, or not provided in accordance with the contract remain unaffected.

3. Right of Withdrawal for Consumers in the EU and the EEA

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the date the contract is concluded.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement, such as an email or a letter.

You may use the sample withdrawal form included at the end of this withdrawal policy. However, you are not required to use the form.

To meet the withdrawal deadline, it is sufficient for you to send the notice of your intention to exercise your right of withdrawal before the withdrawal period expires.

4. Consequences of Withdrawal

If you effectively cancel the contract, we will refund all payments we have received from you without delay and no later than fourteen days from the date we receive your notice of cancellation.

We will generally use the same payment method for the refund that you used for the original transaction. An exception applies only if a different method of refund has been expressly agreed upon.

Bags and Seams Design will not charge you any additional fees for the refund. Fees charged by your bank, credit card company, or other payment service provider due to currency conversions or their own terms and conditions are beyond our control.

5. Premature Expiration of Digital Content

For digital content that is not delivered on a physical medium, the right of withdrawal expires as soon as we have begun fulfilling the contract, provided that you have previously:

1. you have expressly agreed that we may begin fulfilling the contract before the fourteen-day cancellation period expires;

2. have confirmed that you are aware that, by giving your consent, you will lose your right of withdrawal once the performance of the contract begins; and

3. You have received a confirmation of the contract, including your consent and information regarding the loss of the right of withdrawal, on a durable medium, specifically via email.

Performance of the contract begins, in particular, as soon as:

* a download link has been provided;
* a digital file has been made available for download;
* the download has started;
* an online course has been activated;
* login credentials for a course area have been sent;
* course videos or course materials can be accessed.

Once the right of withdrawal has effectively expired, there is no entitlement to a return, exchange, or refund simply because digital content is no longer desired, has not been downloaded, or an online course has not been used or has not been used in full.

Mandatory statutory rights regarding defective or non-conforming digital content remain in effect.

6. Commencement of Digital Services During the Cancellation Period

If a booked service is legally classified as a service rather than digital content, you may expressly request that we begin performing it even before the withdrawal period expires.

If you cancel the contract after requesting an early start, before the service has been fully provided, you may be required to pay a reasonable amount for the portion of the service already provided up to the time your cancellation was received.

This amount is based on the ratio of the services already rendered to the total scope of services agreed upon in the contract.

The right of withdrawal is completely forfeited in the case of a service if:

1. the service has been fully provided;

2. you have expressly agreed in advance that we may begin performing the service before the withdrawal period expires; and

3. You have confirmed that you lose your right of withdrawal once the contract has been fully performed.

7. Personalized Digital Content

Under applicable law, there may be no right of withdrawal for digital content that is created, customized, or specifically tailored to your personal needs in accordance with your specifications.

This may include, for example, custom-tailored sewing patterns or digital documents created specifically for you.

Any mandatory rights arising from defective performance or performance not in accordance with the contract remain unaffected.

8. Regulations for Consumers in the United Kingdom

For consumers who have their habitual residence in the United Kingdom, mandatory U.K. consumer rights apply.

For digital content, the statutory right to cancel the contract may not apply if, before the content is made available, you:

1. you have expressly agreed to the immediate commencement of service; and

2. have confirmed that you thereby lose your right to cancel the contract.

Your consent and the information regarding the loss of rights will be documented in the contract confirmation.

To the extent that a transaction is legally classified as the provision of a service, the mandatory British regulations regarding the commencement and full performance of the service during the statutory cooling-off period apply.

9. Customers from other countries

For customers outside Switzerland, the European Union, the European Economic Area, and the United Kingdom, the mandatory rights of withdrawal, rescission, and consumer protection of their country of habitual residence apply, to the extent that these rights are applicable to the contract.

Unless applicable law provides for a mandatory right of cancellation or return, Bags and Seams Design does not grant any voluntary right of cancellation, return, or exchange for digital content that has already been provided or online courses that have already been unlocked.

10. Required Consent During Checkout

To ensure that digital content and online courses can be made available immediately after payment, a separate, unchecked consent box is required during checkout.

The statement could read as follows:

“I expressly request that Bags and Seams Design begin providing the digital content or online course I have ordered before the expiration of any applicable cancellation or cooling-off period. I am aware that, as a result, I will lose my statutory right of withdrawal or right to cancel the contract upon the start of the provision, to the extent provided for by applicable law.”**

Without this consent, the provision of the service may be withheld until the expiration of any applicable statutory withdrawal or cooling-off period.

The approval is documented along with the order, the date, the version of the text used, and the order number, and is included in the contract or order confirmation.
