1. Scope<\/p>

1.1<\/p>

These General Terms and Conditions, hereinafter referred to as \u201cGTC,\u201d apply to all contracts concluded through the online store operated by Sarah Weise under the business name \u201cBags and Seams Design\u201d at www.bagsandseamsdesign.com.<\/p>

1.2<\/p>

Bags and Seams Design offers the following digital products and services in particular:<\/p>

a) digital sewing patterns and sewing instructions, particularly as PDF files or in comparable digital file formats;<\/p>

b) pre-recorded online courses and other digital learning content on sewing bags;<\/p>

c) digitally created or personalized content, if applicable.<\/p>

No physical goods will be shipped unless otherwise expressly stated in the respective product description.<\/p>

1.3<\/p>

This offer is generally intended for consumers worldwide. Consumers are natural persons who enter into a contract primarily for purposes that are not attributable to their commercial or self-employed professional activities. <\/p>

1.4<\/p>

Any conflicting terms and conditions of business or contract provided by the customer shall not become part of this contract unless Bags and Seams Design has expressly agreed to their validity in writing.<\/p>

1.5<\/p>

Mandatory statutory consumer rights that apply based on the customer\u2019s habitual residence and may not be excluded by contract remain unaffected.<\/p>

2. Language of the Contract<\/p>

2.1<\/p>

The online store can be offered in German, English, and French, among other languages.<\/p>

2.2<\/p>

The contract is concluded in the language that was made available to the customer during the ordering process and that the customer selected.<\/p>

2.3<\/p>

In the event of any contradictions or differences in interpretation between the various language versions, the German version shall prevail, to the extent permitted by mandatory applicable law.<\/p>

3. Product Description and Conclusion of the Contract<\/p>

3.1<\/p>

The presentation of digital products and online courses in the online store does not, in principle, constitute a legally binding offer. It serves as an invitation to the customer to place a binding order. <\/p>

3.2<\/p>

The customer can select the desired products and add them to the virtual shopping cart. Before submitting the order, the customer can review the order details and correct them using the functions provided during the ordering process. <\/p>

3.3<\/p>

By clicking the button that finalizes the order subject to payment, the customer submits a binding offer to enter into a contract for the digital products or services contained in the shopping cart.<\/p>

The order button used must clearly indicate that payment is required, for example, with the label \u201cOrder with Payment Required,\u201d \u201cBuy Now,\u201d or a similarly unambiguous phrase.<\/p>

3.4<\/p>

The contract is concluded as soon as the first of the following events occurs:<\/p>

a) Bags and Seams Design sends an explicit order confirmation via email;<\/p>

b) the payment is successfully completed and confirmed by Bags and Seams Design or the payment service provider used;<\/p>

c) The download, the download link, or access to the online course is provided.<\/p>

An automatically generated acknowledgment of receipt constitutes acceptance of the contract only if this is clearly stated in its content.<\/p>

3.5<\/p>

Orders are processed through WordPress and WooCommerce. Online courses and related content can also be made available through the systeme.io course platform. <\/p>

3.6<\/p>

Once the order is complete, the customer will receive a confirmation at the email address provided during the ordering process. The customer is responsible for providing a valid and accessible email address and for ensuring that messages from Bags and Seams Design are not blocked by spam or other filters. <\/p>

3.7<\/p>

Bags and Seams Design may save a copy of the contract. The customer should save the order confirmation, the product description, and these Terms and Conditions for their own records. <\/p>

4. Prices, Currencies, and Taxes<\/p>

4.1<\/p>

The prices displayed in the online store are final prices in the selected or displayed currency.<\/p>

The online store can offer the following currencies in particular:<\/p>

Swiss franc (CHF);<\/p>

Euro (EUR);<\/p>

U.S. dollar (USD);<\/p>

British pounds (GBP).<\/p>

4.2<\/p>

Sarah Weise, also known as Bags and Seams Design, is not currently registered in the Swiss VAT registry. Swiss VAT is therefore not shown separately. <\/p>

4.3<\/p>

If foreign value-added, sales, or digital taxes, or comparable consumption taxes, are applicable based on the customer\u2019s place of residence, habitual residence, or location, these may be calculated and shown during the ordering process.<\/p>

4.4<\/p>

The total price displayed during checkout before the order is completed is the final price.<\/p>

4.5<\/p>

If payments are made in a currency other than the billing currency of the payment method used, the bank, credit card company, or other payment service providers may charge conversion or processing fees. Bags and Seams Design has no control over such fees. They are not included in the price charged by Bags and Seams Design. <\/p>

4.6<\/p>

Since we offer only digital products and services, there are generally no shipping costs or import duties for physical deliveries.<\/p>

5. Terms of Payment<\/p>

5.1<\/p>

The available payment options are displayed in the online store and during the checkout process.<\/p>

Depending on the country, device, and payment service provider used, the following payment options, in particular, may be available:<\/p>

Credit or debit card;<\/p>

PayPal;<\/p>

Apple Pay;<\/p>

Google Pay;<\/p>

Other electronic payment methods offered through WooCommerce or an integrated payment service provider.<\/p>

TWINT and bank transfers are not currently available.<\/p>

5.2<\/p>

Payment is due immediately upon completion of the order.<\/p>

5.3<\/p>

Payment processing may be handled by external payment service providers. The terms and conditions, terms of use, and privacy policy of the respective payment service provider may also apply to payment processing. <\/p>

5.4<\/p>

If a payment cannot be successfully processed or collected retroactively, Bags and Seams Design is entitled to block or withhold access to the download or course until payment is made in full.<\/p>

5.5<\/p>

Chargeback, processing, or other fees incurred as a result of an unauthorized chargeback or incorrect information provided by the customer may be charged to the customer in an amount that is reasonable and corresponds to the actual costs incurred. The customer reserves the right to prove that no damage was incurred or that the damage was significantly less. <\/p>

6. Provision of digital sewing patterns and files<\/p>

6.1<\/p>

Digital sewing patterns, instructions, and other downloadable products will be made available after the order and payment have been successfully completed, specifically in one or more of the following ways:<\/p>

a) via a download link on the order confirmation page;<\/p>

b) via a download link sent by email;<\/p>

c) through a personal customer account;<\/p>

d) through a secure members-only or course area.<\/p>

6.2<\/p>

Access is generally granted automatically and immediately after payment has been confirmed. We reserve the right to experience temporary delays due to payment verification or technical issues. <\/p>

6.3<\/p>

The customer is responsible for saving the provided files to a suitable storage medium of their own after downloading them. Unless otherwise specified in the product description, there is no guarantee that a download link will remain available indefinitely. <\/p>

6.4<\/p>

The technical requirements for use are specified in the respective product description. Unless otherwise stated, the customer needs, in particular: <\/p>

an Internet-enabled device;<\/p>

a sufficiently stable Internet connection;<\/p>

a current web browser;<\/p>

software for opening PDF files;<\/p>

a printer or access to a printing service, if necessary;<\/p>

sufficient storage space.<\/p>

6.5<\/p>

Color variations, differences in appearance, or minor dimensional deviations may result from differences in monitors, printers, print settings, paper sizes, or scaling. Before cutting, the customer must check the control square and the print scale in particular. <\/p>

7. Provision of Online Courses<\/p>

7.1<\/p>

Online courses are provided primarily through systeme.io or another platform mentioned in the product description.<\/p>

7.2<\/p>

Once payment has been successfully received, access will be sent to the email address provided during checkout or activated through a user account.<\/p>

7.3<\/p>

The specific content, scope, and duration of course access are outlined in the respective product description.<\/p>

If the product description does not specify a particular access period, access is granted for a reasonable period of time, but at least for the duration of the access period explicitly advertised. Unlimited or lifetime access is granted only if this is explicitly stated in the product description. <\/p>

7.4<\/p>

Terms such as \u201cpermanent access,\u201d \u201clifetime access,\u201d or similar phrases refer\u2014unless expressly stated otherwise\u2014to the period during which Bags and Seams Design offers the course in question in its current form, both economically and technically. This does not establish any entitlement to the continued operation of the website, the company, or a specific third-party platform for the customer\u2019s entire lifetime. <\/p>

7.5<\/p>

Bags and Seams Design is entitled to update or supplement course content, or to replace it with content of equivalent value, provided that this does not impair the essential purpose of the contract.<\/p>

7.6<\/p>

If there are significant technical, legal, or operational reasons, Bags and Seams Design may switch course platforms. In this case, a reasonable alternative means of access will be provided whenever possible. <\/p>

7.7<\/p>

The customer is responsible for ensuring that the technical requirements for participation are met. These include, in particular, a stable internet connection, a suitable device, an up-to-date browser, and the ability to receive emails. <\/p>

7.8<\/p>

We do not guarantee any specific learning, sewing, business, or financial success. Success depends, among other things, on the customer\u2019s personal skills, experience, the equipment used, and the customer\u2019s implementation. <\/p>

8. Right of Withdrawal and Return<\/p>

8.1 Swiss Customers<\/p>

Under Swiss law, there is generally no statutory right of withdrawal or return for ordinary online purchases.<\/p>

Bags and Seams Design does not grant any voluntary right of cancellation, return, or exchange for digital content and online courses, unless otherwise expressly agreed or required by mandatory law.<\/p>

8.2 Customers from the European Union or the European Economic Area<\/p>

Consumers who are habitually resident in the European Union or the European Economic Area generally have a statutory right of withdrawal of fourteen days for distance sales contracts.<\/p>

For digital content that is not delivered on a physical medium, the right of withdrawal expires as soon as performance of the contract has begun, provided that the customer, prior to the start of delivery:<\/p>

a) has expressly agreed that Bags and Seams Design may begin performing the contract before the expiration of the cancellation period;<\/p>

b) has expressly confirmed that he or she is aware that, by giving this consent, he or she loses the right of withdrawal upon the commencement of the performance of the contract; and<\/p>

c) has received confirmation of the contract and this consent on a durable medium, in particular by email.<\/p>

Performance of the contract begins, in particular, as soon as the download link, the digital file, or access to the online course is provided or activated.<\/p>

8.3 Customers from the United Kingdom<\/p>

For consumers who have their habitual residence in the United Kingdom, mandatory U.K. consumer rights apply.<\/p>

For downloads, streaming services, and other digital content, the statutory right to cancel the contract may lapse upon the start of provision, provided that the customer:<\/p>

a) has expressly consented to the immediate commencement of service;<\/p>

b) has confirmed that he or she thereby loses the right to cancel the contract; and<\/p>

(c) this consent is documented in the contract confirmation.<\/p>

8.4 Checkout Consent<\/p>

In order for digital content or an online course to be made available immediately after payment, the customer must confirm a separate, unchecked declaration during checkout.<\/p>

Without this consent, Bags and Seams Design may withhold delivery until the expiration of any legally applicable cancellation or cooling-off period.<\/p>

8.5 No Exclusion of Mandatory Rights Regarding Defects<\/p>

The exclusion of a voluntary right of return or cancellation does not preclude any mandatory rights in the case of defective, damaged, incorrectly provided, or unusable digital content.<\/p>

9. Personalized Digital Content<\/p>

9.1<\/p>

To the extent that Bags and Seams Design offers digital content that is custom-created or tailored to personal specifications, the information provided in the respective product description also applies.<\/p>

9.2<\/p>

The customer is responsible for providing all information necessary for personalization completely and accurately, and for reviewing it before completing the order.<\/p>

9.3<\/p>

Once individual processing has begun, changes can only be made to the extent that they are technically and organizationally feasible. Any additional work may be billed separately, provided prior notice is given. <\/p>

9.4<\/p>

There is no voluntary right to return or exchange digital content that has been custom-made according to customer specifications or clearly personalized. Mandatory statutory rights remain unaffected. <\/p>

9.5<\/p>

To the extent that mandatory applicable law requires express consent for the early commencement of services, Bags and Seams Design will not begin custom work until such consent has been granted.<\/p>

10. Rights of Use for Sewing Patterns, Instructions, and Downloads<\/p>

10.1<\/p>

All patterns, instructions, graphics, photographs, texts, videos, course materials, and other content offered by Bags and Seams Design are protected by copyright.<\/p>

10.2<\/p>

Upon full payment, the customer receives a simple, non-exclusive, non-transferable, and non-sublicensable right to use the purchased digital product for their own private purposes.<\/p>

10.3<\/p>

The customer may save the purchased file on their own devices and print it for their own use, unless the product description states otherwise.<\/p>

10.4<\/p>

In particular, without the prior express permission of Bags and Seams Design, it is not permitted to:<\/p>

a) To disclose files, patterns, instructions, or course materials, in whole or in part, to third parties;<\/p>

b) Sharing content via messaging services, email, cloud storage, social networks, forums, websites, file-sharing platforms, or other platforms;<\/p>

c) to sell, rent, give away, or otherwise transfer files or access credentials;<\/p>

d) to make content publicly available;<\/p>

e) to copy patterns, texts, graphics, videos, or other content, in whole or in part, and present them as one\u2019s own works;<\/p>

f) to modify, translate, reproduce, or adapt the content, and to distribute or sell the adapted version;<\/p>

g) Use the content for training sessions, courses, workshops, clubs, groups, or educational purposes, unless a separate license has been purchased for each participant or a separate written license agreement has been entered into;<\/p>

(h) circumventing technical protection measures.<\/p>

10.5<\/p>

The purchase of a sewing pattern does not transfer copyright or any other exclusive rights to the customer.<\/p>

10.6<\/p>

Commercial use of the patterns or the sale of bags made using the patterns is permitted only if this is expressly allowed in the respective product description or has been approved in advance in writing by Bags and Seams Design.<\/p>

Unless express permission has been granted, commercial use is prohibited.<\/p>

10.7<\/p>

Any permission to sell one-of-a-kind items you have sewn yourself does not include the right to offer the pattern itself, patterns derived from it, industrial mass-produced items, or goods produced by third parties.<\/p>

11. Rights of Use for Online Courses and Videos<\/p>

11.1<\/p>

Access to the course is personal and may only be used by the person who purchased the course.<\/p>

11.2<\/p>

Sharing login information or allowing multiple people to use a single course account is not permitted.<\/p>

11.3<\/p>

Course videos may only be viewed on the designated platform, unless downloading is expressly permitted.<\/p>

11.4<\/p>

In particular, the following is prohibited:<\/p>

a) Download, record, or otherwise permanently save course videos or audio recordings, unless a download function is expressly provided;<\/p>

b) to make screen recordings, audio recordings, photographs, or recordings of the course content;<\/p>

c) to reproduce course videos or course materials, in whole or in part;<\/p>

d) to share course content with third parties, whether for free or for a fee;<\/p>

e) to publicly display, stream, upload, or make available course content;<\/p>

f) to use the content for your own courses, training sessions, or commercial offerings;<\/p>

(g) to circumvent access restrictions or other technical protection measures.<\/p>

11.5<\/p>

If there is reasonable suspicion of unauthorized disclosure or misuse, Bags and Seams Design may temporarily suspend access and investigate the matter.<\/p>

In the event of a significant or repeated breach of contract, access may be permanently suspended following a prior request to cease such conduct. In the case of particularly serious violations, access may be suspended immediately. We reserve the right to pursue further claims. <\/p>

12. Obligations of the Customer<\/p>

12.1<\/p>

The customer must provide complete and accurate information when placing an order.<\/p>

12.2<\/p>

Login credentials must be kept confidential and protected from access by unauthorized persons.<\/p>

12.3<\/p>

If a customer becomes aware of unauthorized use of their account, they must immediately notify Bags and Seams Design at info@bagsandseamsdesign.com.<\/p>

12.4<\/p>

The customer is responsible for the following before cutting fabric:<\/p>

to check the selected file version;<\/p>

to check the print settings;<\/p>

to print without page adjustment or at the specified scale;<\/p>

to measure the control square;<\/p>

to read the instructions in their entirety;<\/p>

if necessary, to first create a prototype.<\/p>

12.5<\/p>

The use of sewing machines, irons, rotary cutters, scissors, needles, and other tools is at your own risk. You must follow the manufacturer\u2019s instructions and safety guidelines for the equipment and tools you use. <\/p>

12.6<\/p>

Minors may use the content only with the consent and under the appropriate supervision of a parent or legal guardian or a qualified adult.<\/p>

13. Technical Availability<\/p>

13.1<\/p>

Bags and Seams Design strives to ensure that the online store, downloads, and course platform are available with as few interruptions as possible. However, we cannot guarantee that they will be available at all times without any disruptions. <\/p>

13.2<\/p>

Temporary restrictions may arise, in particular, due to:<\/p>

Maintenance work;<\/p>

Security updates;<\/p>

technical problems;<\/p>

Disruptions affecting Internet, hosting, payment, or platform providers;<\/p>

force majeure;<\/p>

Cyberattacks;<\/p>

Changes to or interruptions in third-party services.<\/p>

13.3<\/p>

Scheduled maintenance is performed during periods of low usage whenever possible.<\/p>

13.4<\/p>

In the event of a significant disruption that is not merely temporary, Bags and Seams Design will, whenever possible, offer a reasonable alternative solution.<\/p>

14. Defects and Technical Problems<\/p>

14.1<\/p>

The mandatory statutory rights apply in the event of defective digital content or services.<\/p>

14.2<\/p>

Customers are asked to report technical problems or defects as soon as possible by email to info@bagsandseamsdesign.com and to provide the following information:<\/p>

Name and the email address used for the order;<\/p>

Order number;<\/p>

Name of the product or course;<\/p>

Description of the problem;<\/p>

device and operating system used;<\/p>

browser used;<\/p>

If applicable, an error message or a screenshot.<\/p>

This request does not limit your legal rights.<\/p>

14.3<\/p>

In the event of a broken download link, a corrupted file, or a lack of access to a course, Bags and Seams Design will first be given the opportunity to resolve the issue within a reasonable period of time.<\/p>

This can be remedied, in particular, by:<\/p>

a) sending a new download link;<\/p>

b) the re-release of the file;<\/p>

c) the replacement of a damaged file;<\/p>

d) the restoration or extension of course access;<\/p>

e) the provision of a technically equivalent alternative solution.<\/p>

14.4<\/p>

If a material defect cannot be remedied within a reasonable period of time, the customer is entitled to the rights provided for under mandatory law.<\/p>

14.5<\/p>

In particular, no defect exists if content cannot be used due to missing or unsuitable technical equipment, incorrect printer settings, missing software, an inadequate Internet connection, or use by the customer that does not comply with the instructions.<\/p>

15. Liability<\/p>

15.1<\/p>

Bags and Seams Design is fully liable for damages caused by willful misconduct or gross negligence.<\/p>

15.2<\/p>

Liability for damages resulting from death, bodily injury, or harm to health, as well as liability under mandatory statutory provisions, remains unaffected.<\/p>

15.3<\/p>

In the event of a breach of a material contractual obligation due to slight negligence, liability is limited, to the extent permitted by law, to the direct damages that were typically foreseeable at the time the contract was concluded.<\/p>

Essential contractual obligations are obligations whose fulfillment is essential to the proper performance of the contract and on whose fulfillment the customer may reasonably rely.<\/p>

15.4<\/p>

To the extent permitted by law, Bags and Seams Design is not liable for:<\/p>

a) Damage resulting from improper use of sewing machines, irons, cutting tools, or other devices;<\/p>

b) Damage resulting from failure to follow safety, material, care, or manufacturer instructions;<\/p>

c) Material losses resulting from incorrect print settings, scaling, dimensional specifications, or cutting;<\/p>

d) minor variations attributable to the characteristics of the screen, printer, paper, or materials;<\/p>

e) temporary outages beyond the direct control of Bags and Seams Design;<\/p>

f) a specific achievement in learning, sewing, sales, or business.<\/p>

15.5<\/p>

The foregoing limitations of liability also apply to the benefit of employees, agents, vicarious agents, and service providers engaged by Bags and Seams Design, to the extent permitted by law.<\/p>

16. Data Protection<\/p>

16.1<\/p>

Personal data is processed in accordance with applicable data protection regulations.<\/p>

16.2<\/p>

Further information regarding the nature, scope, purpose, legal basis, and duration of data processing, as well as the rights of data subjects, is provided in the separate privacy policy at www.bagsandseamsdesign.com.<\/p>

16.3<\/p>

The following services or technologies, in particular, may be used to operate the online store, process payments, provide courses, measure reach, display reviews, perform search engine optimization, and conduct marketing:<\/p>

WordPress;<\/p>

WooCommerce;<\/p>

systeme.io for newsletters, automated emails, and course delivery;<\/p>

Google Analytics;<\/p>

Trustindex;<\/p>

Rank Math;<\/p>

Meta advertising services, including, where applicable, Meta Pixel or similar tracking technologies;<\/p>

Payment service providers such as PayPal, credit card companies, Apple Pay, or Google Pay.<\/p>

16.4<\/p>

Analytics, marketing, and other non-essential technologies will be activated only after the user has given consent, to the extent required by law.<\/p>

16.5<\/p>

Details regarding the services used, data recipients, international data transfers, retention periods, options for revocation, and cookie settings must be described in the separate Privacy and Cookie Policy.<\/p>

17th Newsletter<\/p>

17.1<\/p>

If a customer subscribes to a newsletter, Bags and Seams Design processes the data necessary for sending the newsletter and, if applicable, for measuring its usage.<\/p>

17.2<\/p>

systeme.io can be used to send newsletters.<\/p>

17.3<\/p>

Subscription to the newsletter is voluntary. Consent may be revoked at any time with future effect, in particular by using the unsubscribe link in each newsletter email or by sending a message to info@bagsandseamsdesign.com. <\/p>

17.4<\/p>

The lawfulness of the processing carried out prior to the withdrawal remains unaffected.<\/p>

18. Changes to These Terms and Conditions<\/p>

18.1<\/p>

The version of these Terms and Conditions that was available at the time the contract was concluded generally applies to an order.<\/p>

18.2<\/p>

Bags and Seams Design may amend these Terms and Conditions for future contracts, particularly in the event of changes to the offer, technical processes, or the legal situation.<\/p>

18.3<\/p>

Changes do not apply retroactively to individual purchases that have already been fully completed, unless the parties expressly agree otherwise or mandatory law requires an adjustment.<\/p>

18.4<\/p>

To the extent that changes to long-term course enrollments affect existing contractual relationships, the customer will be notified in writing in a timely manner. Essential contractual obligations may not be modified to the customer\u2019s disadvantage without a valid reason. <\/p>

19. Governing Law<\/p>

19.1<\/p>

All legal relationships between Bags and Seams Design and the customer shall be governed by the substantive law of Switzerland, excluding conflict-of-laws principles and the United Nations Convention on Contracts for the International Sale of Goods.<\/p>

19.2<\/p>

With respect to consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded to them by mandatory provisions of the country of their habitual residence.<\/p>

20. Jurisdiction<\/p>

20.1<\/p>

To the extent that an agreement on the place of jurisdiction is permitted by law, the place of jurisdiction shall be the registered office of Bags and Seams Design in Wangen near Olten, Switzerland.<\/p>

20.2<\/p>

For consumers, the mandatory statutory jurisdictions apply. A consumer\u2019s right to bring a claim before a competent court at his or her habitual residence remains in effect to the extent provided for by applicable law. <\/p>
